What is the Government Plan?

It is the law of probate.

That's right, it is the law.

"But I have a will, which is all I need."

Untrue. A will is a wish document. In other words, by having a will you are telling the probate court judge what your “wishes” are. The court has to validate your will and make sure no one is contesting it. Then, after all debts are paid, the court orders that your remaining assets be distributed to the heirs you named in your will. It is a stressful, long, and costly process, at a time when your loved ones are at their most vulnerable. Even worse, your estate is exposed to the world for identity theft.

You only have two options:

1) Ignore these facts and like it or not, your family will be stuck with the Government Plan. What is involved in having to go through probate?

• A minimum of 6 months to as long as several years to complete the process.

• Legal and court costs ranging from 3% to 10% of an estate's value.

• A lot of stress for the executor, even with an attorney.

• Battling both real and fraudulent debt collectors.

• Loss of family privacy, and

• The risk of identity theft (search "theft beyond the grave").

2) Opt out of the Government Plan with your own personal plan called a Living Trust.

A trust is a legal contract and avoids probate.
